These Terms of Use (“Terms”) govern your use of hollyup.com and the HollyUp planner (the “Service”), operated by HollyUp (“we”, “us”). By using the Service you agree to these Terms. If you do not agree, please do not use the Service.

What HollyUp is

HollyUp suggests ways to spend free time — plans made of a few stops, articles and ideas — based on the choices you make. HollyUp is an information service. We do not operate, own or control the restaurants, venues, parks, transport or activities we mention, and we do not make reservations on your behalf unless a page clearly says otherwise.

Plans are suggestions, not guarantees

  • Prices are estimates. Costs shown in plans and articles are rough, per-person estimates to help you compare options. Actual prices, taxes, tips and fees will vary.
  • Details change. Opening hours, menus, availability, admission rules, ferry and transit schedules change without notice. Please check with the venue or operator before you go.
  • Use your judgment. Consider weather, heat, trail conditions, travel times, accessibility, age suitability and your own health and safety. Follow local laws, posted rules and official warnings.

Third-party sites and affiliate links

The Service links to websites and services run by others, including booking and reservation partners. Some links are affiliate links, which means we may earn a commission if you make a purchase, at no extra cost to you. Your dealings with third parties — including bookings, payments, cancellations and refunds — are solely between you and them, under their terms.

Your use of the Service

You agree not to misuse the Service, including by:

  • submitting false information, spam or content that is unlawful or infringes others’ rights;
  • scraping, copying or republishing plans, articles or data in bulk without our written permission;
  • interfering with the Service’s security or operation, or accessing non-public areas;
  • using the Service to build a competing product or dataset.

Email and communications

If you give us your email address, you agree that we may send you the plans and updates you asked for. Every message includes a way to unsubscribe. See our Privacy Policy for how we handle your information.

Intellectual property

The Service, including its design, text, plan formats, graphics and software, is owned by HollyUp or its licensors and protected by law. You may use the Service and share links to plans and articles for personal, non-commercial purposes. Names and trademarks of venues and brands belong to their owners and are used only to identify them.

Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, HollyUp disclaims all warranties, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that any information in it is complete or current.

Limitation of liability

To the fullest extent permitted by law, HollyUp will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from your visits to third-party venues, your use of third-party services, or your reliance on information in the Service. Our total liability for any claim relating to the Service is limited to one hundred U.S. dollars (US$100). Some jurisdictions do not allow these limitations, so they may not apply to you.

Indemnity

You agree to indemnify and hold HollyUp harmless from claims arising out of your misuse of the Service or your violation of these Terms.

Changes and termination

We may change or discontinue any part of the Service, and we may update these Terms. The date at the top of this page shows when they last changed; continuing to use the Service after a change means you accept the updated Terms. We may suspend access for anyone who violates them.

Governing law

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in King County, Washington, unless applicable law requires otherwise.
